2. Online Ordering and Application Use

2.1 The Online Ordering Application is owned and operated by the licensor of the license agreement. By using this application, you also agree to abide by the terms of that license agreement.
2.2 We make every effort to ensure the accuracy of the information on the Online Ordering Application. However, errors may occur, and you should verify information before placing an order.
2.3 By placing an order, you acknowledge and accept that it is a binding offer to purchase the selected products and services at the agreed online prices.
2.4 All orders are subject to acceptance at our discretion, confirmed by an on-screen message, email notification, or SMS.

3. Account Registration and Confidentiality

3.1 To use the Online Ordering Application, you may be required to provide contact details, create an account, and accept cookies.
3.2 You are responsible for maintaining the confidentiality of your account, personal details, password, and payment information. Any unauthorized use of your account must be reported immediately.

4. Ordering, Pricing, and Payment

4.1 Prices and product availability are subject to change without notice and may vary between online and in-store.
4.2 Payment methods accepted will be displayed at checkout. If paying by credit or debit card, ensure that the card is valid on the date of order placement.
4.3 Once placed, an online order cannot be modified or canceled through the website or offline by calling the Restaurant. Please contact us directly to address any payment disputes or refund claims.

5. Delivery and Pick-Up

5.1 Orders can be delivered or picked up as per the options selected at checkout. Delivery times are estimates and are not guaranteed due to factors like weather or traffic conditions.
5.2 Delivery orders are subject to: i) your address falling within the defined delivery area; ii) the availability of the Restaurant to accept online orders; iii) a potential minimum order amount.
5.3 You agree to accept delivery at the agreed time and place. If no one is present to receive the order, we will charge the full amount, and no refund will be provided. Risk in the products passes to you upon delivery.

6. Cancellation and Refunds

6.1 Orders cannot be canceled once food preparation has begun. If you need to cancel or complain about your order, contact the Restaurant using the details in the order confirmation email.
6.2 Refunds will be handled in compliance with New Zealand's Consumer Guarantees Act 1993 and the Fair Trading Act 1986.

7. Food Allergies and Dietary Preferences

7.1 We strive to accommodate dietary preferences and provide accurate information about ingredients used. However, cross-contamination or ingredient changes may occur.
7.2 It is your responsibility to inform us of any allergies or dietary restrictions when placing an order. We do not guarantee our products are allergen-free.

9.1 To the fullest extent permitted by New Zealand law, the Restaurant excludes all liability for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your use of the Online Ordering Application.
9.2 The Restaurant shall not be responsible for any loss or damage resulting from the delay of delivery, circumstances beyond our control, or any unauthorized changes to the Online Ordering Application by third parties.
